The applicant was restrained from residing in village Tulshi till conclusion of the trial by order dated 18/02/2020 under which he was released on bail.

The said order, however, conferred a liberty upon him to file an application, seeking modification/relaxation of the said condition after a reasonable period.

The applicant has moved the present application on 25/02/2021, projecting his difficulty.

The application, which has come up for hearing today, deserves a consideration since, the applicant states that he has his agricultural land in village Tulshi and in absence of the said land being cultivated, the financial resource for his family has dried up. It is also stated that his whole family continue to reside in village Tulshi.

Accepting the said explanation and recording that reasonable period has expired from passing of the order dated 18/02/2020, imposing fetters upon him from entering into village Tulshi, I am inclined to relax the said condition. 5.

Resultantly, condition No.4(ii) in the order dated 18/02/2020 stands deleted. The applicant shall, however, continue to abide by the other conditions imposed on him. 6.
