2.
This is an application for bail by the applicant- Pragati Ramchandra Zore in connection with C.R. No. 613 of 2021 dated 23/07/2021, registered with Charkop Police Station, under sections 306, 504 and 506 of the Indian Penal Code, 1860.
3.
The date of the incident on which Ankit Kokare committed suicide is 16/07/2021. Ankit left behind a suicide note. There are on record conversations between the deceased and the applicant. The applicant and the deceased were in a love relationship. From the 1/3
conversations it is seen that the relationship became strained. The applicant did not did not want the interference of the parents of the deceased in their life and she wanted the deceased to cut off his relationship with his parents, if the deceased wanted to continue the relationship with the applicant. The applicant was using local language and abusing the deceased as well as his parents. 4.
Admittedly, from the records it appears that there was a love relationship between the applicant and the deceased. The WhatsApp chats/conversations revealed the abusive overtones used by the applicant against the parents of the deceased. Whether the same is sufficient to attract the ingredients of the offence under section 306 is a matter of trial. The suicide note and the contentions therein are not sufficient to deprive the applicant the facility of release on bail. The applicant is in custody since 03/11/2021 almost for the period of 1 year and 1 month. The investigation is complete and the charge-sheet is filed. No purpose will be served by prolonging the custody of the applicant as the trial is not likely to conclude any time soon. The applicant is a lady without any criminal antecedents. In such 2/3
circumstances, she could be released on bail. Hence, the following order.
: ORDER :
