It is not in dispute that after filing of the charge sheet, the applicant has applied for discharge. The learned counsel for the applicant states that the said application is still pending. In view of pendency of the application for discharge, at this stage, this application for quashing the FIR under section 482 of the Code of Criminal Procedure,1973 need not be entertained. It will be open for the applicant to move the concerned Court for giving necessary priority to the hearing of the application for discharge considering the present health condition of the applicant and his age. We are sure that if a case is made out, the learned Judge will give necessary priority to the disposal of the application for discharge.
apl206 Criminal application is accordingly disposed of. All contentions on merits are kept open.
