On instructions learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file a fresh application before the City Civil Court as according to the learned counsel for the petitioner during the pendency of the application for impleadment there was conveyance which was executed in favour of the proposed defendants. 2.
