The applicant is convicted for offence under Section 326 of the Indian Penal Code and has been sentenced to suffer Rigorous Imprisonment for three years and to pay a fine of Rs.5000/-in default to suffer further Simple Imprisonment for 3-months. The Appellate Court has dismissed the appeal. 2) The learned counsel for the applicant submitted that the applicant herein suffered brain hemorrhage on 8.1.2016 and had to under go MRI and Angiography. He placed on record the documents regarding the treatment taken by the applicant.
3) As the maximum sentence imposed by the Trial Court is 3 years, the substantive sentence imposed upon the applicant is hereby suspended on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount before the Trial Court.
