This Application preferred by The New India Assurance Company Limited for condonation of 102 days delay in filing the First Appeal challenging the judgment and award dated 07072012 passed by the Additional Member M.A.C.T. & 1st Adhoc District Judge, Thane in MACP No. 463 of 2009. Present civil application stands dismissed against respondent No.8.

Considering the submissions made by the learned counsel for the Applicants and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, the following order:
a) Delay of 102 days in filing First Appeal is condoned.
b) Office is directed to make appropriate endorsement in the cause title of the First Appeal that First Appeal stands dismissed against Respondent No. 8 Satyadev Ramdas Yadav.
c) Civil Application stands disposed of accordingly.
