The grievance of the petitioner is that respondent no.2 - Committee has not decided the petitioner's caste validity claim which is pending before it since 7th November, 2013. He submits that for want of caste validity certificate, the respondent no.4 had issued a communication to the petitioner that if caste validity certificate is not produced, the petitioner's examination form will not be accepted. A notice issued by the respondent no.4 to the petitioner to that effect has been placed on record by the learned counsel appearing for the petitioner. The same is taken on record and marked "X" for identification.
rpa 2/2 wp-2672-17.doc Keeping in view the fact and circumstances of the case, we are inclined to allow the petition by directing the caste validity committee to decide the petitioner's caste validity claim as expeditiously as possible but not later than three months from the date of receipt of this order.
Till the caste validity claim of the petitioner is decided, respondent no.4 shall not take any coercive steps against the petitioner and the petitioner's examination form shall not be refused to be accepted on this ground. Writ Petition is disposed of.
Petitioner to appear before respondent no.2-Caste Scrutiny Committee alongwith copy of this order on 7th March, 2017.
