On the last date of hearing, the learned APP was directed to verify the status of the case. The learned APP has brought to my notice that the impugned order was passed in C.C.No.204/N/2003 under Section 183 and 185 of the Merchant Shipping Act, 1958. By the impugned order the application was returned to the petitioner with liberty to present it before the Appropriate Forum. 2.

None present for the petitioner. It is seen that the petitioner was not present even on the last date of hearing. It appears that the petitioner is not interested in proceeding with the petition. Hence the petition is dismissed for non­prosecution. (ANUJA PRABHUDESSAI, J.)
