..... Respondents Mr.Kishore Mhatre, a/w. Ms.Manasi Tipnis, i/b. Mhatre & Associates for the Petitioner.

Mr.S.D.Rayrikar, A.G.P. for the State - Respondent nos. 1 to 3. CORAM :

R.D. DHANUKA, J.

DATE :

12th FEBRUARY, 2018 P.C.

It is an admitted position that the self line of the food articles Vanaspati Ruchi No.1 has already expired in respect of which an order came to be passed by the respondent nos.2 and 3 to recall. In view of the ad-interim order passed by this court, the stock could not be recalled. The petition has thus become infructuous. It is made clear that this court has not gone into the validity of the impugned action initiated by the respondent nos. 2 and 3. If any action is taken in future based on the fresh cause of action, the authority shall decide the same on its own merits. Writ petition is disposed of as infructuous with aforesaid clarification. No order as to costs. 2.

In view of the disposal of the writ petition, Civil Application No.758 of 2015 does not survive and is accordingly disposed of. [R.D. DHANUKA, J.]
