The learned counsel for the rival parties inform this Court that the MINAL SANDIP PARAB by MINAL SANDIP PARAB Date:

2023.04.13 17:54:56 +0530 disputes between the parties are now settled. As a result, it would not be necessary to press the petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator. Equally, it would be necessary to allow the appeal under Section 37 of the said Act. The respondent in the appeal, in view of the settlement, is agreeable for setting aside the order dated 03.02.2020 passed by the District Court at Pune under Section 9 of the said Act.

In view of the above, Arbitration Petition No.14 of 2022 is disposed of as withdrawn and Arbitration Appeal No.11 of 2021 is allowed. Consequently, the impugned order dated 03.02.2020 passed by the District Court at Pune is set aside.

In view of the disposal of the aforesaid petition and the appeal, pending applications stand disposed of.
