This Petition is directed against the order dated 06.10.2018 passed by the learned Additional Sessions Judge, Pune thereby rejecting the application below exhibit 44 in Sessions Case No. 519 of 2016. 2.

The petitioner is facing prosecution under sections 395, 170, 384, 385, 386, 342 read with 34 of the Indian Penal Code. The petitioner is on bail since 15.06.2016.

The learned counsel for the petitioner submits that by this Petition, the petitioner seeks permission to travel abroad i.e., Dubai and Istanbul. He further submits that the petitioner wants to leave India on 12.04.2019 and he will return on 21.04.2019. He further submits that the petitioner will furnish an itinerary and address of his work place at Istanbul and Dubai and also furnish the address of hotel where he is going to stay. 4.

The learned APP submits that the petitioner has no criminal record and has no objection if he travel abroad and come back within stipulated period.

In view of above submissions, I allow this Petition with following order :

ORDER

(i) The order dated 06.10.2018 passed by the learned Additional Sessions Judge, Pune is hereby quashed and set aside;

(ii) The investigating officer/ trial Court is directed to handover the passport to the petitioner by tomorrow i.e., 20.03.2019 to enable him to obtain Visa;

(iii) The petitioner is permitted to travel abroad i.e., Dubai and Istanbul for the period from 12.04.2019 to 21.04.2019; (iv) The petitioner is directed to return the passport to Nazir of the trial Court on or before 25.04.2019 and to report about his arrival.
