Heard learned counsel for the applicants and learned APP for the Respondent - State.

By this application, the Applicants seek their enlargement on bail in connection with C.R.No.539 of 2014 registered with the Borivali Police Station, Mumbai for the alleged offences punishable under Sections 370(3), 34 of the Indian Penal Code and under Sections 3, 4, 5 and 7 (1)

2/4 (b) of PITA Act. Both the applicants are alleged to have taken the premises on rent where the alleged trafficking had taken place. Admittedly, all the 3 girls who were arrested, pursuant to the raid which was conducted were major. It appears from the statement of the 3 victim girls that they were doing prostitution on their own accord and will. 3.

Learned APP states that the applicants do not have any antecedents.

Considering the peculiar facts of the case, the Applicants deserve to be enlarged on bail on the following terms and conditions ;

ORDER

i) The Applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- each with one or two local sureties in the like amount ;

ii) The Applicants shall attend the Borivali Police Station, Mumbai, on first Saturday of every month, between 10.00 a.m. to 11.00 a.m., till the conclusion of the trial;

3/4 iii) The Applicants shall not leave the jurisdiction of Mumbai and Thane, without the leave of the Trial Court.

iv) The Applicants shall give their present address and telephone numbers to the Investigating Officer as well as to the Trial Court ;

v) If there is change in the address, the Applicants shall inform the same to the Investigating Officer as well as to the Trial Court ;

vi) The Applicants shall not tamper or attempt to influence any person concerned with the case ; vii) The Applicants shall co-operate in the conduct of the trial ;

viii) It is made clear, that if there is breach of any of the conditions as stated above, the prosecution shall be at liberty to seek cancellation of Applicants' bail. 5.

The Application is allowed and disposed of in above terms. 6.

The aforesaid observations are prima-facie, and the Trial

4/4 Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order. 7.
