The Petitioner has already filed an Appeal before DRAT against the impugned order dated 22 September 2017 passed by the DRT, Mumbai. However, the DRAT, Mumbai is not available and charge has been handed over to DRAT, Chennai. Learned Counsel for the Petitioner fairly states that he will move the DRAT, Chennai for appropriate reliefs. He however urges that the taking over possession of the secured asset scheduled on 3 March 2018 at 11 a.m. may be deferred.

In the circumstances, we direct that taking over possession of the secured asset by the Respondent-Bank be deferred till 15 March 2018. We Uday.P.Kambli 1/2
