This is an application for relaxation of condition imposed while granting bail vide order dated 24/09/2020 passed in Criminal Bail Application (ST) No.1972 of 2020. 2.

Heard Mr.Anees Aslam, learned counsel for the Applicant and Mr.Ajay Patil, learned APP for the State. 3.

Learned counsel for the Applicant submits that the Applicant is now gainfully employed. Therefore it is difficult for Nesarikar

2 / 3 him to report to the police station on every alternate Monday as directed by the earlier order. He submitted that the Applicant has diligently followed directions issued under that order. Therefore this condition be relaxed.

I have considered this submission and I have perused the earlier order. The offence for which he was granted bail was u/s 302 of the IPC. Therefore condition cannot be totally deleted. It was imposed with some purpose. However, considering genuine difficulty of the Applicant and the statement made by learned counsel for the Applicant that he has diligently followed the directions, the condition can be modified to a certain extent.

Hence, the following order :

O R D E R

(i) The condition (iii) imposed in order dated 24/09/2020 in the aforementioned

3 / 3 Criminal Bail Application, is modified and the Applicant is directed to report to the concerned police station every first Sunday of the month between 01.00 p.m. to 02.00 p.m. to mark his presence.

(ii) It is made clear that the other conditions mentioned in the earlier order dated 24/09/2020, shall remain as they are.

(iii) With this modification, the application is disposed of.
