Heard learned Advocate for the Applicant. This Court passed Order dated 10th April, 2024, directing the parties to take instructions as to whether the Appellants have surrendered or whether their sentence is suspended till now.

The learned Advocate for the Applicants submits that the applicants have not surrendered though the Judgment is passed on 18th January, 2024, and the sentence is only 3 months. The present Applicants have already deposited the amount of fine.

Considering that the sentence is of only 3 months the same deserves to be suspended. Hence the following order.

2 5-(2)-IA-855-2024.doc a) The sentence awarded by the Additional Sessions Judge, Nashik, in Sessions Case No. 390 of 2021, dated 18th January, 2024, stands suspended. b) All the Applicants be enlarged on bail executing the P. R. Bond and solvent surety in the sum of Rs. 15,000/-.

The Interim Application stands disposed of.
