Heard learned counsel appearing for the applicants, learned advocate for the respondent no.1 and learned additional public prosecutor for the State.
The applicants have been convicted for the offence punishable under section 138 of the Negotiable Instruments Act and have been sentenced to suffer simple imprisonment till rising of the court and pay a compensation of Rs.19,00,000/- to the complainant / respondent no.1. Their appeal stands dismissed.
During the pendency of the present revision application, the dispute has been resolved amicably. The Borey 1/2
spb/ 15revn107-14.doc respondent no.1 has shown willingness to compound offence, if she receives whole amount of compensation.
It is submitted by the learned counsel for the applicants that an amount of Rs.5,50,000/- is deposited in the trial court by the applicants. The applicants have paid Rs. 13,50,000/- to respondent no.1. Respondent no. 1 is personally present before the court. She confirms receipt of the said amount.
In view of the amicable settlement, the offence committed by the applicants is declared to be compounded. The applicants are acquitted of the offence punishable under section 138 of the Negotiable Instruments Act. Their bail bonds, if any, shall stand cancelled.
An amount of Rs.5,50,000/- deposited by the applicants in the trial court shall be paid to respondent no.1. The consent terms / pursis has already been filed in the court.
In view thereof the above, the revision application stands disposed of.
