This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 419 of 2022 registered at Sinhgad Police Station, Pune for the offences punishable under Sections 302, 307, 141, 143, 144, 147, 148, 149 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State and perused the statement of eye-witnesses. 4.

According to the eye-witnesses, on the date of incident, which took place on 25 September 2022, the co-accused Sunny Chavan, Kanchan P Dhuri 1 / 2

904-ABA-630-2023.odt Sudarshan Bhegade, Prakash Kank, Raju Gaikwad and six other unknown persons assaulted the deceased and committed his murder. 5.

One of the co-accused during interrogation had disclosed that present applicant was with them at the time of alleged assault. Considering the nature of offence, the custodial interrogation of the applicant would be necessary. I am therefore not inclined to grant anticipatory bail to the present applicant. In the result, the following order is passed : (i) Application is rejected.
