This is a successive application for bail by the Applicant. The Applicant has now been served with the copies of CCTV footage and C.A. Report.

The Trial Court in para No.7 of the impugned Order dated 7th December 2020 passed in Sessions Case No.536 of 2018 has observed that, the Applicant was not willing to proceed with the trial as the copies of CCTV footage and CA Report were not served.

Record indicates that, now the Applicant has been served with the same and is willing to proceed with the trial. Learned A.P.P., on instructions, submitted that, the prosecution intends to examine 17 witnesses in support of its case. That two witnesses 1/2

Osk 44-Ba-1066-2021.odt have already been examined as of today and 15 witnesses are remained to be examined.

In view thereof, the learned counsel for the Applicant, on instructions, seeks leave to withdraw present Application with liberty to file a fresh application for bail before the Trial Court, if the trial arising out of C.R. No. 292 of 2018 (Sessions Case No. 536 of 2018) pending on the file of Additional Sessions Judge, Pune does not conclude within a period of nine months from today.

Leave and liberty granted.

Bail Application is disposed off as withdrawn with aforesaid liberty.
