It is submitted before this Court that by way of the present petition, the petitioner prayed for direction to the respondent -authority to promote him to the post of Additional Commissioner w.e.f. July 2010 as per the Government Resolution dated 20th July, 1981, in Pimpri Chinchwad Municipal Corporation.

Mr. Sakhdeo, learned counsel appearing for the Corporation submitted that the petitioner has filed certain representations to the 1/3

Commissioner of Pimpri Chinchwad Municipal Corporation. Learned counsel for the petitioner admits this factual position and further submitted that as these representations were filed some time back, the petitioner be permitted to submit a detailed and comprehensive representation to the respondent - authority i.e. Commissioner of Pimpri Chinchwad Municipal Corporation and the respondent-authority be directed to decide that representation expeditiously. This being now a limited grievance raised by the petitioner, we deem it appropriate to dispose of the petition by passing the following order :

O R D E R

(1) The petitioner is permitted to file a fresh, detailed and comprehensive representation to the Commissioner, Pimpri Chinchwad Municipal Corporation within a period of two weeks from today.

(2) On receipt of such representation from the petitioner within two weeks, the Commissioner, Pimpri Chinchwad Municipal Corporation, shall decide the same on its own merits and pass a reasoned order as expeditiously as possible and not later than ten weeks thereafter.

(3) In case, the petitioner is aggrieved by the decision of the Commissioner, Pimpri Chinchwad Municipal Corporation, the petitioner is at liberty to avail all appropriate remedies including approaching judicial forum challenging the order passed by the 2/3

Commissioner, Pimpri Chinchwad Municipal Corporation.

(4) All the contentions of the respective parties are expressly kept open.

In view of the above, the petition stands disposed of. 4.

All concerned to act upon a copy of this order duly authenticated by the Registry of this Court.
