Heard The Applicant is seeking pre-arrest protection in Crime No.42/2022 registered with Chinchwad, Police Station, District-Pune for offence punishable under Sections 406 and 420 r/w.34 of Indian Penal Code. 2.

It was the informant's case that he has paid amount of Rs.5 Lakhs to the applicant towards investment which was allegedly not returned. It is informed that the matter is settled and the entire amount has been refunded by the applicant to the Sandip Shantaram Nikam who is present in court and identified by the learned APP. Upon instruction, the learned APP submits that the informant has received entire amount.

Considering the nature of accusation and the informant's submission there is no difficulty in granting Sharada

37.aba.630.22.doc pre -arrest protection . In view of that following order:- a.

Ad interim relief granted by this Court vide order dated 8th March 2022 is hereby made absolute upon same term and conditions.

b.

Since the entire amount is paid, clause 2 and 3 of interim order would not survive.

c.

Application stands disposed in above terms.
