This application is filed under Section 24 of the Code of Civil Procedure, 1908, for transferring the Hindu Marriage Petition No.A1225 of 2017 from Family Court, Pune to Family Court, Nagpur. 3.
This application is filed by the Applicant-wife against the Respondent-husband. However, admittedly, the Applicant is residing, along with her two children, at Fairfield in USA. Her father is looking after her matter in her absence.

Needless to state that, as regards the part of recording of evidence, it will be mostly done on the video conferencing and as regards the father of the Applicant is concerned, he may have to attend the Court at the most once or twice, as the Advocate for the Applicant is very much there to take care of the remaining formalities. Therefore, no case is made out for transfer of the proceedings.

Hence, the Miscellaneous Civil Application stands dismissed. 6.
In view thereof, Civil Application No.194 of 2018, pending in the present Miscellaneous Civil Application, does not survive and the same is disposed off as infructuous.
