The applicants are apprehending arrest in connection with C.R.No.52 of 2021, registered with Naya Nagar Police Station, Mira Road, for the ofences punishable under Sections 143, 147, 149, 326, 385, 504, 506 and 427 of Indian Penal Code ("IPC", for short). First Information Report ("FIR", for short) was lodged on 6th February, 2021, by Ajit Vijay Londhe. It is alleged that accused were involved in extortion as well as incident of assault. One Raja Madesiya has been arrested. Case was registered with same police station on 1st February, 2021 at the instance of Prema Raja Madesiya for the

rpa 2/3 13 aba 632 2021(2).doc ofences punishable under Sections 354, 324, 504 and 506 of IPC in respect to the incident dated 1st February, 2021. Ajit Vijay Londhe is impleaded as accused in the said FIR. The present incident is also alleged to have been occurred on 31st January, 2021.

Learned APP submits that the nature of injuries sustained by informant Ajit Londhe are simple in nature. Thus, it is debatable whether Section 326 could be attracted in this case. The applicants are women. The allegation for commission of ofence under Section 385 of IPC are attributed to the cou accused.

Considering the aforesaid circumstances, the applicant need not be subjected to custodial interrogation. Hence, I pass the following order:

:: O R D E R ::

(i) Anticipatory Bail Application No.632 of 2021, is allowed;

rpa 3/3 13 aba 632 2021(2).doc (ii) In the event of arrest of the applicants in connection with C.R.No.52 of 2021, registered with Naya Nagar Police Station, Mira Road, the applicants be released on bail on executing P.R. Bond in the sum of Rs.25,000/u, each, with one or more sureties in the like amount;

(iii) The applicants shall report the investigating oficer on 16th, 17th and 18th March, 2021, between 11:00 a.m. to 01:00 p.m., and, thereafter, as and when called for by the investigating oficer;

(iv) Anticipatory Bail Application No.632 of 2021, stands disposed of accordingly.
