CORAM: G.S. PATEL, J DATED:

11th July 2017 PC:- 1.

There is a delay of 38 days in preferring this First Appeal. The Civil Application was filed in 2017. The First Appeal is of 2013 against a judgment and award of 27th September 2012 by the learned Civil Judge, Senior Division, Sindhudurg at Oros in Land Acquisition Reference No.66 of 2003. The declaration under Section 6 of the Land Acquisition Act was issued on 2nd January 1999. The delay is explained in paragraphs Nos.2 and 3. This delay is because the Law and Judiciary Department took some time to scrutinize the matter. There were many matters pending. Further time was taken in drafting and preparing the Memorandum of Appeal.

11th July 2017

58-CAF1856-17.DOC 2.

The delay is condoned and the Civil Application is made absolute. It is disposed of in these terms.
