It is seen that by order dated 17/08/2020, the learned Additional Sessions Judge, Greater Bombay had granted temporary bail to the Applicant on the ground of the death of his grand mother. It is seen that till date, the Applicant had not surrendered and that he has filed bail application on the ground of parity. When this fact was brought to the notice of Mr. Patil, learned counsel for the Applicant, he states that the Applicant shall surrender before the Superintendent of Arthur Road Jail on 06/05/2022 by 11:00 a.m.

The Applicant seeks leave to withdraw the Bail Application with liberty to file fresh application before the trial Court on the ground of parity after surrender of the Applicant. Leave with liberty is granted. 1/2
