Challenge in this petition is to the refusal to grant ad-interim relief in favour of the petitioners. According to the petitioners, the relief prayed by the petitioners is urgent in nature as they are apprehending that persons appointed as trustees may misappropriate the trust funds and trust properties. Immediate threat is of disposal of trust funds, therefore, it is necessary that immediate measures under the provisions of the Act are required to be taken by the Charity Commissioner.

In the impugned order the Charity Commissioner has recorded a prima facie finding that grave urgency is not found.

However considering the facts of the case, it is in the fitness of things that the Charity Commissioner shall decide the interim prayer of the petitioners after hearing the respondents within one week from 14th March 2024.

With this clarification, the petition stands disposed of. No costs.
