This is the second bail application filed by the applicant who is facing trial in Sessions Case No. 117 of 2019 pending on the file of the Addl. Sessions Judge, Kalyan, for offences punishable under Section 302, 307 of the Indian Penal Code.

While disposing the previous bail application (BA/1590/2021) this Court had observed that the deceased had suffered multiple stab injuries on his abdomen and chest. It was further observed that there is prima facie material to show the involvement of the applicant in committing the said crime, and accordingly the application was dismissed on merits. 3.

The subsequent bail application is filed only on the ground that P P SALGAONKAR

11 ba 643-23.doc there is no progress in the trial. The applicant is accused of committing murder. The mere ground that the trial is not concluded within two years is not a ground to entertain the second bail application. Hence, Application is dismissed.
