Heard the learned Counsel for the parties.

This is an application for pre-arrest bail in connection with C.R.No.622 of 2022 registered with Tulinj Police Station for the offences punishable under Sections 420, 447, 448, 506 read with Section 34 of the Indian Penal Code. 3.

By an order dated 2 March 2023, this Court was persuaded to grant interim bail as the applicant was not named in the FIR and the husband of the applicant in whose favour the allegedly fabricated instrument was executed, was arrested and had since been released on bail. 4.

The learned APP submitted that though the applicant had appeared before the Investigating Officer, she has not rendered necessary co-operation. 5.

From the perusal of the FIR, it appears that the allegedly executed SSP 1/2

26 aba 626 of 2023.doc instrument was executed in her favour.

The learned Counsel for the first informant submitted that applicant has been claiming proprietary and possessory title over the subject lands and the said claim has been negated by the courts.

The claim of proprietary and possessory title over the subject lands may be patently false. However, that cannot be a ground to decline the relief of pre-arrest. I am, therefore, impelled to make the order dated 2 March 2023 absolute. 8.

The order dated 2 March 2023 is made absolute on the terms and conditions incorporated therein.

The applicant shall appear before the Investigating Officer as and when directed by the Investigating Officer.

10.

The applicant shall regularly attend the proceedings before the jurisdictional court.

11.

The Application stands disposed.
