This is an application for condonation of delay of 226 days in preferring the application for leave to file appeal.

The learned counsel for the respondent No.2 opposed the application on the ground that the delay is substantial in nature and no proper explanation is offered by the applicant for condoning the same. He further submitted that if this Court is inclined to condone the delay, heavy cost may be imposed upon the applicant.

For reasons stated in the application and in the interest of justice, I am inclined to condone the delay subject to condition that the applicant shall pay Rs.2000/- to the High Court Legal Services Authority. The payment of cost is condition precedent for condonation of delay. Application is allowed in terms of prayer clause (a) subject to aforesaid condition.
