The petition is filed for challenging the election of the respondent no.1. Under Section 80 of the Representation of the People Act, 1951, no election shall be called in question except by election petition presented in accordance with the provisions of the said Act. Such election can be challenged by filing election petition only. In that view of the matter, this PIL is not maintainable. In addition to this, the petitioner has no locus to challenge the election of the respondent no.1. The petition is devoid of merits and is accordingly dismissed.
