DATED : 11th MARCH, 2022 P.C:- Heard learned counsel for the applicant, learned counsel for the complainant and learned APP for the State. The applicants who are apprehending their arrest in C.R.No.933/21 invoking Sections 408, 420, 465, 468, 471 r/w Section 34 of the IPC.

On the last date of hearing, learned counsel for the applicants made a categorical submission that the same consent

2/3 23 aba 632-22.doc terms are drawn between the applicants and the complainant and the same were tendered before me. Noting that the terms are signed by the three applicants and the informant i.e. Karan Sehgal on behalf of Beekalene Fabrics Pvt.Ltd and asked the Investigating Officer to record the statement of the complainant, where he has accorded his consent to the terms on his free well. Accordingly, on 10/3/2022, statement of the complainant is recorded by the Investigating Officer which is placed before me by the learned APP. The complainant re-iterate the terms of consent and he also state that the consent has been accorded by him by his free will without any coercion/influence of anyone.

In the wake of the aforesaid statement, the consent terms signed by the applicants and the complainant dated 7/3/2022 are taken on record and marked 'X' for identification. In the wake of the consent terms, the parties intend to approach the competent court from quashing of the FIR itself and the same has been stated in clause (vi) of the consent terms.

O R D E R

(a) In the event of his arrest, the Applicant no.1 Ajay Dhoot, applicant no.2 Aditya R. Dhoot and

3/3 23 aba 632-22.doc applicant no.3 Ramnivas Dhoot in connection of C.R.No.933/2021 registered with MIDC police station shall be released on bail on furnishing P.R. bond to the extent of Rs.50,000/- each with one or two sureties of the like amount.

(b) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade them from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
