DATE: 30 MARCH 2015 P.C. :- 1] This petition is directed against the order dated 27 February 2015, by which the Ad-hoc District Judge- 2, Malegaon, has granted interim relief in favour of the petitioner, subject to the petitioner depositing an amount of Rs.4,50,000/- in the appeal court within a period of one month, failing which it is clarified that the defendants / respondents will be at liberty to proceed for execution of the decree.
2] There is no reason to interfere with the impugned order except that the amount of Rs.4,50,000/-, which the learned counsel for the petitioner states that the petitioner would deposit within a period of four weeks from today, once deposited, be invested in the nationalized bank for a period of one year in the first instance. skc 58-WP-3219-15 statement is made by the learned counsel for the petitioner, on basis of instructions from the petitioner.
3] Further, the learned District Judge is requested to dispose of the appeal expeditiously, since the respondent no. 1 is a widow and a senior citizen. Accordingly, the learned District Judge to dispose of the appeal as expeditiously as possible and in any case within a period of one year from today.
4] With the aforesaid observations, the present petition is disposed of.
