In Civil Application No. 1575 of 2017 1] Considering the reasons set out in the civil application, the order dated 27th April 2017 is recalled and Writ Petition No. 2849 of 2017 is restored.
2] The civil application is disposed of in the aforesaid terms. In Writ Petition No. 2849 of 2017 3] In this writ petition, the challenge is to the orders dated 3rd Setpember 2016 and 17th February 2017, by which, the petitioner, was not permitted to be impleaded as a party to R.A.E. Suit No. 1/2
Dinesh Sherla 14-caw-1575-17.doc 781/1264 of 2012, which was then pending before the Small Causes Court, Mumbai.
4] Learned counsel for respondent Nos.1 to 4 places on record the judgment and decree dated 3rd May 2017, by which, R.A.E. Suit No. 781/1264 of 2012 has been disposed of.
5] With aforesaid development, the reliefs in the main petition are rendered infructuous. The petition is therefore, disposed of as infructuous.
6] In case, the petitioner challenges the judgment and decree dated 3rd May 2017, then they shall also have liberty of challenging the orders impugned in the present petition.
