This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No.22 of 2023 registered at Miraj Rural Police Station, Dist. Sangli for the ofences punishable under Sections 420, 465 and 511 of the Indian Penal Code.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 4.
According to the prosecution, the present applicant on the basis of forged title document had made an application to Grampanchayat, Shipur to mutate his name in Grampanchayat record in respect of property bearing city survey No. 506. Dinesh S. Sherla 1/2

It appears that the application under Section 156 (3) of Cr.P.C. was fled and it was rejected by order dated 18 July 2022. If initially no cognizance of report with the similar allegations was not taken, then it is not understood as to why all of sudden the crime in question was registered that too after rejection of application under Section 156(3) of the Cr.P.C. Considering the facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.
ORDER
A) The Anticipatory Bail Application is allowed. B) In the event of arrest of the applicant in C.R. No. 22 of 2023 registered at Miraj Rural Police Station, Dist. Sangli for the ofences punishable under Sections 420, 465 and 511 of the Indian Penal Code, the applicant be released on bail on executing P.R Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
