The present petition was filed challenging the impugned judgment and order dated 31st March, 2010 in election petition No.3 of 2008 by the Ld. Upper Commissioner, Nashik Region. 2.

Further, today when the matter is called out Mr. Dande learned Counsel appearing for respondent no 3, who is the main contesting party states his client expired about one year ago and as such nothing will survive in the matter.

Mr. Venegaonkar, learned counsel for the petitioner in the meantime submits that he has no instruction in the matter. However, in view of the fact that Respondent no.3 is no more, nothing more will survive. The petition is dismissed as it is infructuous.
