Mr. Venegavkar, the learned counsel appearing for the applicant submits that the original accused No. 1 has fled the appeal being aggrieved by the order of conviction, arising out of same judgment and order, which is the subject matter of present application.

In that view of the matter, since already the Criminal Appeal No. 1457/2018 (Etaz @ Taj Alahuddin Shaikh Vs. Union of India & Anr.) has been fled by the original accused No. 1 has been admitted and pending for hearing, we deem it appropriate to allow Bhagyawant Punde, PA

2/2 909-ALS-140-2019.doc this application seeking leave to appeal. Accordingly, leave is granted.

Registry to register the appeal. After registration of appeal, registry to tag the appeal for hearing with Criminal Appeal No. 1457/2018 (Etaz @ Taj Alahuddin Shaikh Vs. Union of India & Anr.) 4.
