Heard. The learned counsel for the respondent submits that they have no objection if the Civil Application is allowed in terms of prayer clause (a).

Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and as the Advocate for the respondent has no objection for allowing the Civil Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clause (a) which reads thus:

"(a) that this Hon'ble Court be pleased to modify the order dated 19th April 2004 at Exhibit-A hereto permitting the applicant not to deposit wages in respect of respondent Nos.1, 8 and 11 as they have attained the age of 60 which is the age of retirement as per Internal Notice dated 1st January 2012 issued by the applicant company to all the workmen."

b) Civil application stands disposed off accordingly.
