The learned APP on instructions states that charge sheet has been filed against the petitioner on 19th December, 2016. Hence, a remedy is available to the petitioner under the statute. As far as prayer clause (b) is concerned, the petitioner will have to seek appropriate relief in terms thereof after the petitioner is discharged or is acquitted. As of today, the said prayer is premature. Accordingly, the petition is disposed of by granting liberty to the petitioner to file appropriate proceedings in accordance with law.
