Heard learned counsel for the applicant and learned APP for the State.

This is an application for suspension of sentence and bail. The applicant challenges the conviction for the offence punishable under Sections 354, 354-A, 452, 504 and 506 of the Indian Penal Code, 1860 whereby the maximum sentence awarded for these offences is six months. The applicant was arrested on 01.02.2024 after the appeal he had filed came to be dismissed.

I have perused the judgment and order of the conviction passed by the trial Court. There is nothing on 1/2

PMB 25.ia.796-24.doc record to demonstrate that the applicant has misused his liberty while he was on bail during the trial. In the facts and circumstances of the present case, since the Criminal Revision Application which has been admitted, is not likely to be heard soon, the sentence imposed by the trial Court is suspended and the applicant be enlarged on same bail as before the trial Court with fresh bonds. The fine amount has been paid. The applicant is permitted to furnish cash bail surety in the sum of Rs.10,000/- for a period of 8 weeks in lieu of surety.
