The cause for moving the above Writ Petition is that the stay application filed by the Petitioner herein in the Appeal filed by him before the Principal Secretary (Appeals and Security), Government of Maharashtra has not taken up for consideration. The appeal has been filed by the Petitioner against the order dated 6/1/2017 passed by the Licensing Authority i.e. the Collector, Solapur cancelling the Petitioners premises, performances and ticket selling licenses.

In my view, it would be just and proper to stay the said cancellation, pending consideration of the Appeal filed by the Petitioner before the Appellate Authority.

The learned AGP states that the Appeal would be heard and decided within 2 months from date.

In view of the said statement, the Appellate Authority i.e. the Principal Secretary Appeal and Security, is directed to hear and decide the appeal latest by 15/5/2017.

Till the Appeal is decided, there would be a stay to the order dated 6/1/2017 passed by the Licensing Authority.

Needless to state that all the contentions of the parties are kept open for being urged before the Appellate Authority. 7.

With the directions as aforesaid the above Writ Petition is disposed of.
