In furtherance of order dated 20th March, 2019, learned APP, upon instructions from the officer present in the Court, informs that there are no criminal antecedents against the petitioners and record of petitioners is clean. Petitioners, as also respondent nos.2 and 3 are present with their respective counsel. They are jointly requesting for quashing of proceedings. Affidavit is already placed on record by them in support of joint request.
rpa 2/2 7-wp-1015-19.doc It appears that earlier parties were running together the coaching classes and after some time, respondent no.2 and 3 separate started classes in competition. Because of this dispute arose between parties.
In this situation, in the light of joint request and as parties do not have any criminal antecedents, we are inclined to intervene. However, we direct each petitioner as also respondents 2 and 3 to pay amount of Rs.5,000/-, each, as costs. The costs are made payable to Juvenile Justice Fund of State of Maharashtra. Costs amount be paid within three weeks from today.
After the costs amount is paid by each party, relief in terms of prayer Clause (a) shall be made absolute. Writ Petition stands disposed of.
