Mr.Yogesh Sankpal for Respondent No.1.
CORAM: N.M. JAMDAR, J.
DATED : 21 MARCH 2016 P.C.:
Learned counsel for the Appellant, on taking instructions from the Appellants, states that looking at the nature of the dispute and quantum of damages, the Appellant has decided not to pursue this litigation any further. This statement is accepted. In view of this position, it is not necessary to go through the rival contentions. Learned counsel for the parties state that, in paragraph 19 of the decision of the Appellate Court, the damages have been erroneously mentioned as Rs.2,000/- instead of Rs.20,000/-, which is clear from the order of the Trial Court.
bsb 2 3.SA247.16.doc The appeal is accordingly disposed of.
In view of disposal of the appeal, the civil application is also disposed of.
