1] Heard Mr.Jha, learned Counsel for the applicant and Mr.Venegaonkar, learned Counsel for the CBI. The applicant has filed this application challenging the order issuing non bailable warrant against him in Sessions Case No.109 of 2013 (CBI FIR No.RC-2/E/2013-EOW.MUM).

2] The learned Counsel for the applicant states that the applicant will appear before the Special Judge, CBI on 12th March 2015 and file an application seeking cancellation of the non bailable warrant

YBG aba350-15 issued against the applicant. Without going into the merits of the case, the following order is passed:- (a) The applicant shall not be arrested till 12th March 2015; (b) If an application for cancellation of NBW is made before the learned Special Judge, the same shall be decided on its own merits, in accordance with law, uninfluenced by the protection granted by this court.

(c) The present application is disposed of, with the aforesaid directions.

(d) Parties to act on an autnenticated copy of this order; (REVATI MOHITE DERE J.)
