DATE :
8 JUNE 2017 P.C.
1.
This is an Application for anticipatory bail in connection with C.R.No.I 182/2016 registered with Bazar Peth police station. The offence is registered under sections 420,468,471 read with 34 of the IPC. It is the prosecution case that the accused is involved in forgery of documents viz N.A.permission. The Applicant was authorized to carry out the said work. During the course of investigation, it is revealed that the said forged document was procured from one Darekar who was working as a clerk in Collector's office.
2.
The learned Advocate for the Applicant submitted that he has not committed the offence of forgery. He had procured the said document from the aforesaid person and the Applicant has co-
RNG 391.17-12 operated with the investigation. The Applicant was granted protection and was directed to attend the police station. He has complied with the said directions.
3.
Considering the fact that it is the case of prosecution as stated in the say filed by them before the Sessions Court that one Darekar, Clerk working in the office of the Collector is responsible for preparing the forged document and that the Applicant has co-operated with the investigation, I do not find that there is any need for the custodial interrogation of the Applicant. 4.
Hence, I pass the following order:
(i) Interim order dated 30.3.2017 is confirmed.
(ii) The Applicant is directed to attend the Investigating Officer once in a week on every Saturday between 1.00 p.m. to 3.00 p.m. till filing of the charge sheet.
Criminal Application stands disposed of.
