The learned Additional Public Prosecutor has pointed out that the trial has commenced and three prosecution witnesses are examined. He submits that there are total 15 witnesses cited and therefore the trial may be expedited. 3.

The learned counsel for the Applicant has disputed that three prosecution witnesses are examined. That apart it is submitted that the Applicant has undergone total hip replacement and is in need of immediate medical treatment. N.S. Kamble page 1 of 2

A perusal of the order passed by the learned Sessions Judge does not show that the medical ground was pressed into service.

Be that as it may, the present Criminal Application is disposed of. The trial is expedited.

It will be open to the Applicant to apply before the learned Magistrate for appropriate medical aid as may be advised by the concerned Medical Officer attached to the Solapur Prison or the Civil Surgeon/Medical Superintendent, Civil Hospital at Solapur. If such an Application is made the learned Magistrate shall decide the same on its own merits and in accordance with law and shall ensure that proper medical aid is provided to the Applicant as may be medically advised.

It is made clear that this Court has not examined the merits of the Application for bail.
