IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 945 OF 2016 Vipin Bishandas Bhagat Vs. The State of Maharashtra & Ors. ----------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders and Registrar's orders.

----------------------------------------------------------------------------------------------------------------- Mr. Nilesh Pande for Petitioner.

Mr. Deepak Thakare, APP for State.

CORAM : A.S. GADKARI, J.

DATE : 16th April 2016.

P.C.:

1] By the present petition, the petitioner has challenged the interlocutory order dated 10.2.2016 passed by the Judicial Magistrate, First Class, Pimpri in SCC No.7554 of 2008.

2] By an Order dated 4.9.2015 passed by this Court in Writ Petition No.2630 of 2015 the Trial Court was directed to dispose off C.C. No.7554 of 2008 as expeditiously as possible and preferably within a period of six months from the date of receipt of copy of the said order. It appears from the record that despite there being specific order dated 4.9.2015 passed by this Court in Writ Petition No.2630 of 2015, thereby giving directions to the Trial Court, the applicant who is the complainant is preferring redundant applications only within a view to procrastinate the litigation. I have perused the record and the impugned order dated 10.2.2016 and found that the impugned order is well within the conformity of law and needs no interference at the hands of this Court. The Trial Court has rightly rejected the said application.

Dond wp.945-2016.sxw 3] I find no merits in the present petition and the same is accordingly dismissed.
