By this civil application the applicant seeks condonation of delay of 377 days in filing the present second appeal. Learned counsel appearing for the respondent strongly opposes the application on the ground that the applicant has not explained any delay properly. Since both the parties have proposed to address this court on merits, I have proposed to condone the delay of 377 days in filing the second appeal. Civil application is accordingly made absolute in terms of prayer clause (a). No order as to costs.
