Learned counsel for the Respondents pointed out the order dated 09/12/2021 passed in Criminal Appeal No. 260 of 2021 by a Division bench of this court (Coram: Nitin Jamdar and Sarang V. Kotwal, JJ.). It was observed in said order that, in such situation proper remedy would be a Civil Appeal. Learned counsel for the Appellant submits that the proper remedy in this case also would be a Civil Appeal and he seeks permission to convert the present Criminal Appeal into a Civil Appeal.
