Applicant is seeking regular bail in Crime No. 312/2017 registered with Bharti Vidyapeeth Police Station, Pune for offence punishable under Sections 302, 201 of the Indian Penal Code. After charge-sheet was filed, this Court by a detailed order dated 25/07/2018 rejected the prayer for grant of bail. The said order was confirmed in SLP on 29/01/2019.
The liberty is claimed to have been granted by the Apex Court
2 902.665.19 ba.doc to approach this Court for appropriate relief in accordance with Law. As such, this second application.
The learned counsel for the applicant on merits would try to submit that apart from absence of motive, the entire case is based on circumstantial evidence and that being so, applicant is entitled to be released.
The learned APP has opposed the prayer for grant of bail. Having appreciated the aforesaid position, apart from detailed reasons recorded by this Court vide order dated 25/07/2018 passed in BA 1174/2018, the fact remains that there are no subsequent developments which appeals this Court to reconsider the prayer for grant of bail.
The reasons recorded by this Court while passing detailed order of rejecting the prayer for bail are still germane. No different view than the one which is already expressed is possible.
