The order impugned has been passed by the Authority under the provisions of the Maharashtra Tenancy and Agricultural Lands Act, 1948 in exercise of power under Section 84 of the Act. The petitioner has alternative statutory remedy by way of Appeal under Section 74 of the Maharashtra Tenancy and Agricultural Lands Act, 1948 against the impugned order. Therefore, by keeping all questions raised in the present petition, open to be agitated before the Appellate Authority under the Act, the writ petition is disposed of.

The period spent in prosecuting the present petition shall be excluded while considering period of limitation at the time of filing of Appeal.
