This is an application for temporary bail filed by the aforesaid Applicant, who is facing trial in Sessions Case No.728 of 2015 arising out of C.R. No.I-77 of 2015 registered at Indira Nagar Police Station, District-Nashik for offences punishable under sections 302, 120 B, 201, 323, 504 and 506 r/w. 34 of the IPC and under section 135 of the Bombay Police Act.

Heard the learned counsel for the Applicant and the learned APP for the Respondent -State. The learned counsel for the Applicant submits that the Applicant herein is a student of F.Y.B.Sc. and that his final exam is scheduled from 9.3.2016 to 30.3.2016. 1/3

The learned APP was directed to verify the said statement and upon instructions, the learned APP has confirmed that the Applicant herein is a student and is studying in F.Y. B.Sc. and that his examination centre is at Vaijapur, District-Aurangabad. 4.

Considering the above facts and circumstances, the application is allowed and the applicant is granted temporary bail from 8.3.2016 till 30.3.2016 on the following terms and conditions:- (i) The Applicant shall be released on temporary bail on furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand only) with one or two sureties or cash sureties to the like amount to the satisfaction of the learned Sessions Judge, Nashik.

(ii) During the period of bail the Applicant shall reside at Vaijapur, Aurangabad and furnish to the Investigating Officer his contact details as well as the address at Vaijapur, District-Aurangabad.

(iii) The Applicant shall report to Vaijapur Police Station, Aurangabad Rural on every alternate day during the 2/3

period of temporary bail between 5.00 p.m. to 6.00 p.m.

(iv)During the temporary bail, the Applicant shall not leave Vaijapur, District-Aurangabad, without prior permission of this Court.

(v)The Applicant shall surrender to Nashik Central Prison on 1.4.2016 at 10.00 a.m.
